
In a significant observation safeguarding the independence of the legal profession, the Supreme Court of India on Wednesday expressed serious concern over the practice of investigating agencies or police summoning legal professionals in relation to client information or legal advice rendered. The Court held that such actions are prima facie untenable and pose a direct threat to the autonomy of the legal profession.
“Legal profession is an integral component of the process of administration of justice,” the Court remarked. Emphasizing the privileged position of lawyers, the bench noted, “Counsels who are engaged in their legal practice have certain rights and privileges guaranteed both due to their professional status and under statutory provisions.”
The Court cautioned that allowing investigative bodies to directly summon defense counsel or advocates who provide legal advice in a case “would seriously undermine the autonomy of the legal profession and would even constitute a direct threat to the independence of the administration of justice.”
The ruling reinforces the sanctity of client-lawyer confidentiality and reiterates that any intrusion into this protected relationship must be approached with utmost caution and legal propriety.
