Supreme Court Recommends Special Courts for POCSO Cases

 

In a move aimed at expediting the disposal of cases involving sexual offences against children, the Supreme Court of India has directed both the Central and State governments to establish special courts across the country exclusively for POCSO (Protection of Children from Sexual Offences) cases. The court expressed concern over the delays in such cases, including the late filing of charge sheets and shortcomings in police investigations.

As pointed out by the bench comprising Justices Bela M. Trivedi and P.B. Varale, although the POCSO Act prescribes specific time limits for each stage of the proceedings, these timelines are often not adhered to. In this context, the Supreme Court recommended the formation of new courts dedicated solely to handling POCSO cases, emphasizing the need to prioritize this matter.

The court also stressed the importance of providing specialized training for investigating officers. The ultimate goal, it said, is to ensure justice is delivered promptly and efficiently while taking into consideration the psychological well-being of the child victims.

With this directive, it is hoped that a more effective resolution mechanism for POCSO cases will be established. The Court reminded that it is the responsibility of the State governments to implement these recommendations. It also emphasized the need for legal and administrative systems to take serious steps toward building a safe and nurturing society for children in India.
