New Delhi: The recent moves of the Supreme Court Collegium, particularly its recommendation to elevate Justice Vipul Pancholi to the Supreme Court, have raised serious concerns regarding the independence of the judiciary in the country. Reports suggest that Justice B.V. Nagarathna, a member of the Collegium, has strongly dissented against this move. She reportedly warned that Justice Pancholi’s appointment would have an “adverse effect on justice” and could undermine the credibility of the judicial system.
Dissent and Lack of Transparency:
Justice Pancholi, ranked 57th in the list of senior judges, could potentially become the Chief Justice of India between October 2031 and May 2033. However, Justice Nagarathna is said to have questioned the propriety of the Collegium’s decision to consider him, pointing out that while there are already two judges from the Gujarat High Court in the Supreme Court, more deserving candidates have been overlooked.
She also expressed dissatisfaction with the Collegium’s failure to discuss the circumstances of Justice Pancholi’s transfer from the Gujarat High Court to the Patna High Court in 2023. She indicated that this transfer was not a routine administrative matter but had other underlying reasons.
Allegations of Government Influence:
Despite the strong dissent, the Collegium’s official statement made no mention of it. The non-disclosure of Justice Nagarathna’s dissent note contradicts her own demand for transparency. This has led many legal experts to allege that the Collegium may be altering its decisions to align with the interests of the government.
Former Supreme Court judge Justice Abhay S. Oka has publicly demanded that Justice Nagarathna’s dissent note be released, emphasizing that transparency in judicial appointments is essential to safeguard judicial independence.
Since the Supreme Court has not denied these reports, the controversy has only deepened. This raises the critical question of whether the Collegium is truly protecting judicial independence or allowing it to be weakened under external influence. These developments have now emerged as a fresh challenge to the credibility of India’s judicial system.
